xAI turbine case: court refuses to toss NAACP lawsuit
A federal court in Mississippi has denied xAI's motion to dismiss the NAACP's Clean Air Act lawsuit. The case over unpermitted gas turbines powering the Colossus 2 data center will move forward.

What happened
Judge Debra M. Brown of the U.S. District Court for the Northern District of Mississippi denied the motion to dismiss on October 30 (SELC). The Southern Environmental Law Center and Earthjustice sued on behalf of the NAACP in April. The suit alleges that between August and December 2025, xAI and its subsidiary MZX Tech installed and operated 27 gas turbines in Southaven without an air permit (CNBC).
xAI's arguments
- The turbines are "mobile" and therefore exempt from permitting.
- The NAACP has no standing to sue under the Clean Air Act.
- Such citizen suits are unconstitutional.
The court rejected all three. The turbines are not mobile sources under Mississippi's implementation plan, and citizen plaintiffs sue in their own name for their own harm, so they are not exercising federal executive power (TechCrunch). About two weeks earlier, the same court denied a similar motion from the U.S. Department of Justice.
Why it matters for AI
xAI, now part of SpaceX, partly powers its Colossus data centers near Memphis with on-site gas turbines. SELC says the plant could emit more than 5,000 tons of nitrogen oxides, 400 tons of particulate matter and 47 tons of formaldehyde a year. The plaintiffs have also asked for a preliminary injunction, which is still pending.
Bridging the wait for a grid connection with temporary turbines is a common shortcut in fast data center buildouts. This ruling signals that a "temporary" label does not exempt them from air permits. TechCrunch also notes that sentiment toward data centers is souring, with New York recently passing a moratorium on new facilities.
